Different types of Powers of Attorney

Broadly speaking, there are three types of Power of Attorney, it is possible to put in place.

Lasting Powers of Attorney

These are generally the most common type of Power of Attorney that Donors (the person maing a Power of Attorney) put in place nowadays, and are a long-term arrangement whereby it is possible to name one or more people to look after your affairs on your behalf, should you become unwell.

Lasting Powers of Attorney continue to remain in place after the loss of any mental capacity.

Enduring Powers of Attorney

These are been around since 1985, but since Spetember 2007, it is no longer be possible for a Donor a new Enduring Power of Attorney. These documents allow a Donor to one or more people to be responsible for their property and financial affairs. These documents do not cover health and welfare matters.

Ordinary/General Power of Attorney

This is a legal document that allows a Donor to name one or more people to look after their property and financial affairs. Unlike the above two documents, this document does not continue beyond the loss of any mental capacity and would become ineffective if the Donor lost mental capacity.
