Court of Protection applications

I have dealt with a lot of Court of Protection matters during my careeer. Simply put, if a decision has to be made about someone who has lost mental capacity in terms of their finances/property (and indeed health, although this is much more rare) and they have no suitable Power of Attorney, the Court must be asked to make an Order.

Deputyship Orders

I can help with such an applciation where general management is needed over the finances of someone that has lost mental capacity and they have no appropriate Power of Attorney. Read more >

Statutory Wills/Codicils

If someone has lost mental capacity and their Will arrangementrs are out of date or they have no Will, the only organisation that can change their Will (or add a Codicil) are the Court. I have dealt with numerous applciations to alter Wills or make Wills where there is no Will, on behalf of someone that has lost mental capacity. Read more >

Removing an incapable trustee by Court Order

If a trustee has lost mental capacity and the trust does not provide an express power for them to be removed, then an applciation would have to be made to the Court for an Order that they be removed and potentially replaced. Again, I have dealt with applciations like this previously. Read more >

Gifting Applications

Sometimes, there is good reason to apply to the Court for assets held by someone that has lost mental capacity to be given away to beneficiaries during their lifetime. Indeed, I have done several of these. Read more >
